Terms of service
Last updated:
These terms are the agreement between Cyberboost LLC and the business that subscribes to Dhawaq. By using Dhawaq, or by accepting an account we set up for you, you agree to them. If you use Dhawaq on behalf of a business, you confirm that you may bind that business.
1. Who is who
- "We", "us" and "Cyberboost": Cyberboost LLC, licensed in the Qatar Financial Centre under QFC Licence No. 03085, which develops and operates Dhawaq.
- "You" and "merchant": the restaurant, café or other business that subscribes to Dhawaq.
- "Staff": the people you give a Dhawaq login to.
- "Guests": your customers who open your menu, order or pay.
- "Branch": one location of your business, with its own tables, staff and kitchen screen.
2. The service
Dhawaq lets you publish a digital menu, take orders from tables through QR codes, show them on a kitchen screen, keep one bill per table, take payment online through SkipCash or at the counter, design your menu in the visual studio, offer an AI menu assistant, receive reports and use your own address (yourname.dhawaq.com or your own domain).
We improve Dhawaq continuously and may add, change or remove features. We will not remove a core feature you depend on (menu, ordering, kitchen screen, bills) without telling you in advance.
3. Accounts and staff
We create your account after you contact us and send your login details to the owner. You are responsible for everything done with your account and your staff logins: keep passwords confidential, give each staff member their own login and only the access they need, and remove access when someone leaves. Tell us at once at [email protected] if you think an account has been misused.
4. Fees and billing
- The subscription costs 70 QAR per active branch, per month, with all features included for every branch. Prices are shown in Qatari riyals and exclude any taxes that may apply.
- Fees are paid in advance for each period. We send a reminder 7 days before your paid period ends and on the due date.
- Adding a branch adds its fee from the period it is activated. Fees already paid are not refunded, except where the law requires it or we agree otherwise in writing.
- We may change the price with at least 30 days’ notice by email. The new price applies from your next period after the notice ends; if you do not accept it, you can cancel before then.
- SkipCash fees for guest payments are charged by SkipCash under your own SkipCash agreement and are not part of the Dhawaq subscription. Payments from guests go to your SkipCash account, not to us.
5. Late payment and suspension
If fees remain unpaid after the due date, we may suspend the account. While it is suspended, your menu shows as temporarily unavailable, new orders cannot be placed and some panel features, such as the visual studio, are unavailable, but open bills can still be closed and paid. The account is restored once payment is received.
We may also suspend an account straight away if it is used in breach of section 8, or if this is needed to protect the service, other merchants or guests. We will tell you why, unless the law prevents us.
6. Your menu and your guests
You are the seller to your guests, and you are responsible for your business. In particular:
- the accuracy of your menu: names, descriptions, photos, prices, availability, calories, ingredients and allergen information;
- food safety, hygiene and the licences and permits your business needs;
- prices, service charges and taxes you apply, receipts and invoices you must issue, and your accounting;
- your relationship with SkipCash, refunds to guests and handling of guest complaints;
- telling your guests how you use their data, and having a lawful basis to do so (see our privacy policy, where Dhawaq acts on your behalf for guest data);
- paying tips to the waiters they are meant for.
7. The AI menu assistant
The AI assistant answers guests using your menu content. Its answers are generated automatically and can be incomplete or wrong. It does not replace your staff’s advice, especially about allergens, ingredients and dietary or medical needs, and you should make this clear to guests. You may turn the assistant off. You may use your own AI provider key; then that provider’s terms apply to its use as well. Fair-use limits on the number of assistant requests may apply.
8. Acceptable use
You must not use Dhawaq to:
- sell goods or services that are illegal in Qatar or where you operate;
- publish content that is unlawful, misleading, offensive or that infringes the rights of others;
- try to access other merchants’ data, test or break our security, or disrupt the service;
- copy, resell or reverse-engineer Dhawaq, or overload it with automated requests;
- send unsolicited messages or collect guests’ data for purposes they have not been told about.
9. Your content and our platform
You keep all rights in your content: menus, photos, logos and designs. You give us a licence to host, copy, resize and display it only to provide Dhawaq to you and your guests. You confirm that you have the rights to everything you upload.
Dhawaq itself, its software, themes, design, brand and documentation, belong to Cyberboost and its licensors. Your subscription gives you a right to use Dhawaq during the subscription; it does not transfer any ownership.
10. Your address and custom domains
Your menu address yourname.dhawaq.com is provided with the subscription and stays ours; we may refuse or change names that are misleading or infringe a trademark. If you connect your own domain, you remain its owner and are responsible for registering, renewing and keeping its DNS records as we instruct. We are not responsible for downtime caused by changes to your domain or DNS. When an account is cancelled, its custom domains are disconnected.
11. Availability and support
We work to keep Dhawaq available at all times, but we do not guarantee it will be uninterrupted or error-free. We may carry out maintenance, which we plan for quiet hours where possible. Dhawaq depends on internet access and on third-party services such as Cloudflare, SkipCash and our AI provider, and we are not responsible for their outages. Support is provided by email and WhatsApp during business hours in Qatar.
12. Cancellation
You may cancel at any time by writing to [email protected]; the cancellation takes effect at the end of the paid period. We may end the subscription with 30 days’ notice, or at once if you seriously or repeatedly breach these terms.
After cancellation, your menu is no longer published and custom domains are disconnected. Your data is kept so the account can be reopened, unless you ask us to delete it, as described in our privacy policy. Before cancelling, you can ask us for an export of your menu and bill data.
13. Warranties and liability
Except as stated in these terms, Dhawaq is provided "as is", without other warranties, to the extent the law allows.
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost revenue, lost data or damage to reputation, and our total liability for any claim relating to Dhawaq is limited to the fees you paid us in the 12 months before the event that led to the claim. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or gross negligence.
You agree to compensate us for claims by your guests or other third parties that arise from your menu content, your products, your use of guests’ data or your breach of these terms.
14. Governing law and disputes
These terms are governed by the laws and regulations of the Qatar Financial Centre. We will first try to resolve any dispute amicably; if this fails within 30 days, the dispute will be referred to the courts of the Qatar Financial Centre (the QFC Civil and Commercial Court), unless the law requires otherwise.
If there is a difference between the English and Arabic versions of these terms, the English version prevails, to the extent the law allows.
15. General
We may update these terms. We will change the date at the top of this page and tell you by email at least 30 days before significant changes take effect; continuing to use Dhawaq after that means you accept them. If any part of these terms is invalid, the rest remains in force. You may not transfer your account without our written consent. A signed order form or written agreement between us prevails over these terms where they differ.
